A Minna High Court sitting in Minna has adjourned indefinitely trial of Former Governor of Niger State Mu’azu Babangida Aliyu and two others Umaru Mohammed Gado Nasko and the State PDP Chairman Barrister Tanko Beji.
Ruling on an application seeking for an adjournment on the matter, field by counsel to Umar Nasko before the court, Justice Aliyu Maiyaki said that the court is satisfied the conditions containment in the application.
According to him, the court decision to give indefinite adjournment on the matter pending the determination of the another case suit field before an Appeal Court Abuja challenging the non-jurisdiction of the matter.
Counsel to Umaru Nasko, Barrister Sam Adda had earlier told the court that he had field a suit at court of Appeal Abuja challenging the power of Minna High Court not to entertain the case.
Barrister Sam Adda who argued extensively on the application cited some sections of the constitution and related cases to support the application.
The Counsel to the Economic and Financial Crime Commission (EFCC) Barrister Chile Okoroma objected to the application arguing that the send application before court of Appeal is only to course delay in the whole with the application.
He submit that the action of his learned counsel is only to frustrate the proper proceeding on the matter when the prosecution counsel are ready to commence full hearing on the matter.
Barrister Chile Okoroma submit that some of the witnesses arraigned to give evidences on matter are already in court as at yesterday sitting
He cifed some relevant authorities in some related cases to back-up his objection on the application before Appeal Court, Abuja.
