Anti Graft ; Court To Hear Niger Ex Gov Babangida’s Case Next Week.



MINNA ;’The Niger state Court 4 Minna has adjourned to 24/03/ 2020 to give rulling as wether or not to continue the hearing case of criminal breach of trust against the former Governor of Niger state Dr Mu’azu Babangida Aliyu.

Justice Mikail Mohammed announced the adjournment while listening to an application filled by Barrister Isyaku Ibrahim the defense counsel to the accused person on the suit filled by EFCC prosecution counsel Barrister Kabiru Latonu praying court to re list the case for hearing.

Barrister Isyaku Ibrahim submitted that paragraph 8 and 9 that is contained in the earliest suite filled by the EFCC does not contain the facts and urged the counsel to strike out the cade.
According to him,he did not know under which power the Court granted the suite application and urges the court to dismissed the case for lack merit .READ:  Election madness; Thugs set ablaze PDP woman leader in kogi.

Mamman Mark Usman another counsel to the third defendant in his submission adopted the submission of Barrister Isyaku Ibrahim who prayed Court for total dismissal of the case.
According to him the court has no jurisdiction to entertain the re list of the matter as prayed by prosecuting counsel.

The prosecutng counsel to EFCC Barrister Kabiru Latonu submit that it is a gross mis conception of law by the respondent counsel Isyaku Ibrahim to say that a criminal matter can not be re listed for hearing adding that power to hear the application is viewed in the authority of the Federal republic of Nigeria and urged the court to grant the application for re list of the hearing and to allow full hearing on the matter.
